COVENANTS:

Only residential use. Enclosed businesses only on listed properties off of MacArthur and Forrest Hills. Must be approved by development committee.

Only one main home per lot.

Minimum SF of living space 2500sf. Excludes garage, porches, breezeways,... If over one-story at least 2/3 of living space on ground floor.

Minimum 3 car side-load attached garage Pitch of roof minimum 7:12

Roof material HD arch shingle or metal - no cedar shake or clay tile.

Exterior veneer of home 20-50% brick or stone with waiver granted by development committee for farmhouse style w/ board & batten or metal siding.

No lots further subdivided, rearranged or replatted to create more than original lots.

All structures must be approved by development committee prior to any construction activity begins. - Building plans, plot plans, and materials and specs must be provided with application to build.

Development committee serve until 85% of the lots have residences constructed. Committee will consist of 2 members of Forrest Hills Estates LLC and 2 representatives from Gateway Realty.

Construction of new materials only and those materials generally accepted as used in residential application..

Nothing erected prior to main residence. Exception for barns (can grant waiver for temporary living space. Main residence must be completed within 3 months).

Once construction has begun on any structure must complete within 18 months. No structure may be moved onto or placed on any lot.

No temporary or mobile structure, modular or prefab. Max outbuilding size based on acreage size.

Minimum 3 bed, 2 bath

Guest house / pool house allowed. Must be built with same materials as main residence. Same style and color.

Fences - No privacy fences - black chain link or split rail. Will be based on lot size. No junk or abandoned vehicles or recreational vehicles (unless in barn).

No noxious or illegal activity.

HOA turned over when at least 75% of lots sold. CCRs to extend for 10 years

Home or barn, animal shelter cannot be placed in front of home or next to fence. Even with main residence or behind and not to be placed within 200 feet of property line.

Livestock (includes the following: goats/sheep, horses, cows, chickens (no roosters) 1 animal/2 ac

grazing, 2 FFA/4H/3 ac, 3 FFA/4H/4.5 ac, 4 FFA/4H/7 ac, 6 FFA/4H/10+ ac (Max 10), 7+ ac only FFA/4H show pigs.

Pets are not allowed in the community barn. Owners may bring their pets to the common area. Any pet with a repeated history of aggression in the community can result in the forced removal of the pet.

Annual dues $400 @31 ($12,400/yr)
